By accessing or using the website located at kerrvillefencing.com(the "Site"), or by engaging TX Kerrville Fencing for any fence installation, repair, or related service, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Site or engage our services. These Terms apply to all visitors, customers, and others who access the Site or use our services.
TX Kerrville Fencing provides fence installation, repair, replacement, and related services in Kerrville, Texas and surrounding Hill Country communities. Services include, but are not limited to, wood fence installation, vinyl fence installation, chain link fence installation, aluminum fence installation, commercial fencing, privacy fencing, pool fencing, farm and ranch fencing, automatic gate installation, ornamental iron fencing, security fencing, fence staining and sealing, and custom fence design.
All services are subject to availability, geographic service area, and project feasibility as determined by TX Kerrville Fencingat its sole discretion. We reserve the right to decline any project request.
Written estimates provided by TX Kerrville Fencing are valid for 30 days from the date of issuance unless otherwise stated in writing. Estimates are based on conditions observed during the on-site assessment. Conditions discovered after work begins that were not visible or reasonably foreseeable at the time of estimate - such as underground utilities, buried debris, or rock formations deeper than anticipated - may result in adjustments to the final project cost. We will notify you in writing before proceeding with any work that would increase the agreed price.
Verbal estimates are not binding. Only written estimates signed by both parties constitute a binding agreement for a fixed price. Material costs are subject to market fluctuation, and estimates that extend beyond 30 days may require revision.
Project scheduling is confirmed in writing after a signed agreement and any required deposit is received. Installation dates are subject to weather conditions, material availability, and crew availability. TX Kerrville Fencing will notify you as soon as practicable of any necessary schedule change.
If you need to cancel or reschedule a confirmed project, please notify us at least 48 hours before the scheduled start date. We will make reasonable efforts to reschedule. Cancellations made less than 48 hours before the scheduled start date may result in forfeiture of any deposit paid, depending on materials already ordered or pre-positioned for your project.
TX Kerrville Fencing reserves the right to reschedule or cancel a project due to unsafe weather conditions, site access issues, or other circumstances outside our control. In such cases, we will work with you to find the next available date at no additional charge.
Payment terms will be specified in the written estimate or contract for each project. A deposit may be required before work begins, particularly for projects requiring significant material orders. The remaining balance is due upon completion of the work unless otherwise agreed in writing.
Accepted payment methods will be confirmed at the time of estimate. All invoices are due upon receipt unless a different schedule is agreed in writing. Overdue balances may be subject to a late payment fee and may result in work being suspended until the account is brought current.
You agree to pay all costs of collection, including reasonable attorney fees, if we are required to take legal action to collect an unpaid balance.
By engaging our services, you represent that you are the owner of the property where work will be performed, or that you have the legal authority to authorize fence installation or repair on that property.

TX Kerrville Fencing is not responsible for fences installed in incorrect locations based on inaccurate information provided by the customer.
Where required, TX Kerrville Fencing will obtain the necessary building permits before beginning work. Permit fees are typically included in or added to the project estimate. We comply with applicable local building codes and zoning requirements. However, compliance with homeowners association rules, deed restrictions, and neighbor notification requirements is the responsibility of the customer. We are not liable for fines or required modifications resulting from HOA rule violations that were not disclosed to us prior to installation.
TX Kerrville Fencing warrants that all installation work will be performed in a workmanlike manner. Specific warranty terms, if any, will be stated in the written project agreement. Material warranties, if applicable, are provided by the manufacturer and are subject to the manufacturer's terms.
Warranty coverage does not apply to damage caused by extreme weather events, vehicle impact, vandalism, soil movement or settling beyond normal expectations, improper use, or modifications made by anyone other than TX Kerrville Fencing. Natural weathering and color change in wood or other organic materials over time is not a defect and is not covered under any labor warranty.
To the fullest extent permitted by applicable law, TX Kerrville Fencingshall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services or these Terms, including but not limited to loss of use, loss of profits, or property damage not directly caused by our negligence.
In no event shall our total liability to you for any claim exceed the total amount paid by you for the specific service giving rise to the claim. Some jurisdictions do not allow certain limitations on liability, so some of the above may not apply to you.
The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. TX Kerrville Fencing does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We make no warranty regarding the accuracy or completeness of information on the Site.
Before initiating any formal dispute, you agree to contact us in good faith at hi@kerrvillefencing.com and give us a reasonable opportunity to resolve the concern directly. Most issues can be resolved quickly through direct communication.
If a dispute cannot be resolved through direct communication, the parties agree to attempt mediation in good faith before pursuing any other legal remedy. Any legal action not resolved through mediation shall be brought in the courts of Kerr County, Texas.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising from these Terms or from services provided by TX Kerrville Fencing will be subject to the exclusive jurisdiction of the state and federal courts located in Kerr County, Texas.
We reserve the right to update or modify these Terms and Conditions at any time. When we do, we will update the effective date at the top of this page. Your continued use of the Site or our services after any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
